Imaginar lo (im)posible. Aportes feministas-sindicales para repensar el Derecho del Trabajo post COVID-19

Abstract

Objetivo. Este artículo aborda las discusiones en torno a la reformulación del derecho del trabajo desde una perspectiva particular: la necesidad de establecer una articulación feminista-sindical. Metodología. Nos servimos del análisis documental para reconstruir los debates teóricos acerca de la refundación del derecho laboral, que se vienen desarrollando desde hace tres décadas y su revigorización en el marco del lugar que ocupó la disciplina en las respuestas a la crisis sociolaboral desatada por la pandemia de COVID-19. Resultados y discusión. Nuestro argumento principal sostiene que para repensar el derecho del trabajo es imprescindible posicionarse desde una mirada histórica, que recupere la razón de ser de esta porción del ordenamiento jurídico-laboral. A partir de esa localización, tomamos las críticas feministas para problematizar dos ejes fundantes del derecho colectivo del trabajo: la noción de “interés colectivo” y la huelga. Aporte. La conclusión general del artículo señala la importancia de retomar los presupuestos de origen del derecho del trabajo (conflicto social, acción colectiva y respuesta institucional) para ensayar posibles reconfiguraciones de la disciplina en la actualidad. En ese sentido, sostenemos que un derecho del trabajo de/para el siglo XXI, que pretenda mantener y expandir los horizontes tuitivos, debe partir de una alianza constitutiva feminista-sindical.
