Abstract

A partir do primeiro quartel do século XX, as constituições passam a prever direitos, vinculados a uma perspectiva de inclusão, que superam os limites anteriores de mera regulação da estrutura do Estado e a enunciação dos direitos individuais. Exemplo desta preocupação é a redação do artigo 3º da Constituição brasileira de 1988. Contudo, este compromisso não é uma tarefa reduzida ou que possa ser solvida em curto ou médio prazo. Esta visão de atuação sofre constante questionamento. Existem visões de mundo que afastam a responsabilidade do Estado com essa tarefa, transferindo-a para o esforço meramente individual de cada um buscar sua realização pessoal, tentando alterar o modo como ocorre a interlocução Estado e sociedade para afirmar um modelo onde a responsabilidade pela superação das desigualdades é transferido do Estado para a pessoa, alterando as bases de construção do Estado Socia
