¿«Zona gris» o «línea roja»? Diferenciando «señoritas de alterne» de «prostitutas»

Abstract

Una de las «verdades más incómodas» para la sociedad de nuestro tiempo es que hoy, como ayer –lo que contrasta con la mayor libertad sexual–, la «prostitución» existe y también las personas y sociedades que se lucran de ella, sin que la condena penal por el «delito de proxenetismo» reduzca tal existencia. De ahí que la legalización de la prostitución, que tiene tantos partidarios como detractores, esté en el ojo del huracán. Ese debate afecta de lleno al Derecho del Trabajo –y de la Seguridad Social–, en la medida en que hay quien propone su reconducción a contrato de trabajo, mientras que otros entienden que solo tendrían sentido si se ejerce de forma autónoma. Consecuentemente, entra de lleno en el problema de fijación de las «fronteras del Derecho del Trabajo».
