THE INTERNATIONALIZATION OF CRIMINAL LAW: TRANSNATIONAL CRIMINAL LAW, BASIS FOR A REGIONAL LEGAL THEORY OF CRIMINAL LAW

Abstract

El objetivo de este trabajo es presentar las infracciones penales relacionadas con el crimen organizado como consecuencia de un proceso de internacionalización del Derecho Penal en el que intervienen diferentes ordenamientos jurídicos. La metodología seleccionada del presente trabajo se basa en instrumentos que corresponden a una estrategia metodológica cualitativa. A medida que se identifican las unidades informantes: legislación local (legislación penal de los Estados bajo consideración, a saber, los estados miembros permanentes del MERCOSUR), legislación internacional y doctrina legal. En cuanto a la técnica investigativa, se utiliza el análisis documental tradicional: análisis de concurso. Los delitos característicos de este nuevo modelo de Derecho Penal establecen una nueva disciplina, a saber, el "Derecho Penal Transnacional". Como consecuencia de ello, se hace necesario el desarrollo de una dogmática regional del derecho penal para proporcionar seguridad jurídica, pero también para actuar como muro de contención frente a ideas, categorías e intuiciones de otros sistemas de imputación penal que se vuelven disfuncionales cuando se aplican en nuestro sistema. El establecimiento de una regional de derecho penal en torno al Derecho Penal Transnacional se convierte así en una nueva estrategia regional frente a la americanización de la política criminal.

L'objectif de ce document est de présenter les infractions pénales liées au crime organisé à la suite d'un processus d'internationalisation du droit pénal dans lequel différents systèmes juridiques interfèrent. La méthodologie choisie dans le présent article est basée sur des instruments qui correspondent à une stratégie méthodologique qualitative. Au fur et à mesure que les unités déclarantes sont identifiées : législation locale (législation pénale des États considérés, à savoir les États membres permanents du MERCOSUR), législation internationale et doctrine juridique. En ce qui concerne la technique d'investigation, on utilise l'analyse documentaire traditionnelle : l'analyse par concours. Les infractions pénales caractéristiques de ce nouveau modèle de droit pénal créent une nouvelle discipline, à savoir le « droit pénal transnational ». En conséquence, le développement d'une dogmatique régionale du droit pénal devient nécessaire pour assurer la sécurité juridique, mais aussi pour servir de mur de soutènement face aux idées, catégories et intuitions d'autres systèmes d'imputation criminelle qui deviennent dysfonctionnels lorsqu'ils sont appliqués dans notre système. La mise en place d'un droit pénal régional autour du Droit pénal transnational devient ainsi une nouvelle stratégie régionale face à l'américanisation de la politique pénale.

The aim of this paper is to present the criminal offences related to the organized crime as a result of a process of internationalization of Criminal Law in which different legal systems interfere. The selected methodology of the present paper is based on instruments which correspond with a qualitative methodological strategy. As reporting units are identified: local legislation (criminal legislation of the States under consideration, namely permanent member states of MERCOSUR) international legislation and legal doctrine. With regard to the investigative technique, it is used the traditional documentary analysis: contest analysis. The criminal offences characteristic of this new model of Criminal Law sets up a new discipline, namely "Transnational Criminal Law". As a consequence of this, the development of a regional dogmatic of criminal law becomes necessary to provide legal certainty, but also to act as retaining wall facing to ideas, categories and intuitions of other systems of criminal imputation which become dysfunctional when they are applied in our system. The establishment of a regional of criminal law around the Transnational Criminal Law becomes thus a new regional strategy faced with the Americanization of criminal policy.

الهدف من هذه الورقة هو عرض الجرائم الجنائية المتعلقة بالجريمة المنظمة نتيجة لعملية تدويل القانون الجنائي التي تتدخل فيها النظم القانونية المختلفة. تستند المنهجية المختارة لهذه الورقة إلى أدوات تتوافق مع استراتيجية منهجية نوعية. مع تحديد وحدات الإبلاغ: التشريعات المحلية (التشريعات الجنائية للدول قيد النظر، وهي الدول الأعضاء الدائمة في السوق المشتركة لبلدان المخروط الجنوبي) والتشريعات الدولية والعقيدة القانونية. فيما يتعلق بتقنية التحقيق، يتم استخدامها في التحليل الوثائقي التقليدي: تحليل المسابقة. تحدد الجرائم الجنائية المميزة لهذا النموذج الجديد من القانون الجنائي نظامًا جديدًا، وهو "القانون الجنائي عبر الوطني". ونتيجة لذلك، يصبح تطوير عقائدي إقليمي للقانون الجنائي ضروريًا لتوفير اليقين القانوني، ولكن أيضًا للعمل كجدار احتفاظ يواجه أفكار وفئات وحدس الأنظمة الأخرى للإسناد الإجرامي التي تصبح مختلة عند تطبيقها في نظامنا. وبالتالي يصبح إنشاء قانون جنائي إقليمي حول القانون الجنائي عبر الوطني استراتيجية إقليمية جديدة تواجه أمركة السياسة الجنائية.
