In this work psychological and legal issues involving families remarried after divorce are aboarded. This article aims to point out the psychological and legal claims that can arise in these families in order to cooperate with the psychologist called to act in legal proceedings. Through the study of theoretical material on the subject, it was observed that the idealization of the nuclear family model sometimes appears as an obstacle in accepting the implications involving the establishment of a remarried family. It was also noted the need of preserving parental roles at the same time that spaces for stepfather and stepmother are being built. In relation to the legal aspects, the remarried family requests do not yet have specific regulations to satisfy this family formation. The social and legal uncertainty as to what would be up to new members shows that there is a wide network of family relationships to be studied.
