Abstract

Esta tesis busca comprender los elementos restaurativos del Proceso de Reconocimiento liderado por la Comisión de la Verdad en Palestina-Huila, explorando la intersección entre la Justicia Transicional (JT) y la Justicia Restaurativa (JR). Además, propone una aproximación conceptual a la Justicia Restaurativa Transicional (JRT) en el contexto colombiano. A través de un enfoque etnográfico y utilizando la teoría fundamentada, se analiza en detalle el proceso de reconocimiento liderado por la Comisión de la Verdad (CEV) en Palestina-Huila. Se destaca la importancia de una conceptualización del reconocimiento en un sentido amplio, abarcando la dignidad, la responsabilidad y los impactos y afectaciones. Esto es esencial no solo para la búsqueda de la verdad y la construcción de memoria, sino también porque el proceso de reconocimiento se ha convertido en una herramienta clave para la restauración. Siguiendo los principios de la JR, se busca “reparar” (put right) esos daños, centrándose en los daños y necesidades de las víctimas, abordando las obligaciones de los perpetradores e involucrando a todos los actores. Por esas razones, se afirma que el proceso es intrínsecamente restaurativo y además ha permitido el surgimiento de otras prácticas restaurativas, como las propuestas de Trabajos, Obras y Actividades con contenido Reparador y Restaurador (TOAR). Además, este estudio revela cómo la colaboración y comunicación entre distintos mecanismos del Sistema Integral de Paz (SIP) y actores son vitales para la implementación integral del enfoque restaurativo. Finalmente, se presentan algunos aspectos que podrían considerarse como el primer paso para establecer las bases de una teoría fundamentada de la JRT, y se concluye con recomendaciones para mejorar la implementación del enfoque restaurativo.

This thesis seeks to understand the restorative elements of the Recognition Process led by the Truth Commission in Palestina-Huila, exploring the intersection between Transitional Justice (TJ) and Restorative Justice (RJ). Additionally, it proposes a conceptual approach to Transitional Restorative Justice (TRJ) in the Colombian context. Through an ethnographic approach and using grounded theory, the process of recognition led by the Truth Commission (TC) in Palestina-Huila is analyzed in detail. The importance of a broad conceptualization of recognition, encompassing dignity, responsibility, and impacts and effects, is highlighted. This is essential not only for truth-seeking and memory-building but also because the recognition process has become a key tool for restoration. Following the principles of RJ, the aim is to "repair" those damages, focusing on the needs of victims, addressing the obligations of perpetrators, and involving all actors. For these reasons, it is argued that the process is intrinsically restorative and has also allowed the emergence of other restorative practices, such as proposals for Jobs, Works, and Activities with Restorative and Repairing Content (TOAR). Additionally, this study reveals how collaboration and communication among different mechanisms of the Comprehensive Peace System (CPS) and actors are vital for the comprehensive implementation of the restorative approach. Finally, some aspects that could be considered as the first step in establishing the foundations of a grounded theory of TRJ are presented, and recommendations are made to improve the implementation of the restorative approach.
