Abstract

De acuerdo con el modo en que ha sido generalmente entendido, el analisis hohfeldiano de las posiciones juridicas subjetivas esta comprometido con tres tesis implicadas: (i) todos los conceptos hohfeldianos son fundamentales; (ii) ninguno de estos conceptos puede ser definido sin referencia a su relacion con otro concepto del mismo esquema y (iii) el analisis de Hohfeld es circular. El objetivo de este trabajo es discutir estas tesis a las que respectivamente se ha denominado: (i) tesis de la fundamentalidad, (ii) tesis de la interdefinibilidad y (iii) tesis de la circularidad. La autora se propone mostrar que, si bien desde el punto de vista logico, estas tres tesis son verdaderas, ellas presuponen un conjunto de premisas que Hohfeld no explicita: (a) derecho, deber, privilegio y no‑derecho son posiciones de primer orden, mientras potestad, sujecion, inmunidad e incompetencia son posiciones de segundo orden; (b) deber, privilegio, potestad e incompetencia son posiciones activas, mientras derecho, no‑derecho, sujecion e inmunidad son posiciones pasivas; y (c) privilegio, no‑derecho, incompetencia e inmunidad son, a diferencia de las de deber, derecho, potestad y sujecion, posiciones puramente negativas en el sentido de que carecen de autonomia conceptual. La autora argumenta que el analisis de estas premisas implicitas permite advertir que Hohfeld asume un punto de vista que trasciende al estrictamente logico al poner el foco en la utilidad practica de los conceptos hohfeldianos y que, desde este punto de vista, las tres tesis en discusion (i, ii y iii) son falsas.
