Pravo in morala danes

Abstract

Ob soocenju razmisljanj o pravu in morali avtor razcleni in primerjalno opredeli stiri sklope pravoslovnih naukov, s cimer prakticno zaobjame ves razpravni prostor. Naravnopravnistvo, pravni pozitivizem, pravni realizem in novoustavnistvo razloci po najznacilnejsih odgovorih na tri vprasanja: ta se nanasajo na odnose med pravom in moralo, na predmetnost (objektivnost) ali osebkovnost (subjektivnost) eticnih oz. moralnih, politicnih, pravnih vrednostnih sodb in na razlaganje v pravu. Nato iz vsakega od stirih sklopov pravoslovnih naukov izlusci se posebno teorijo (ta oblikuje predmet njihovega preucevanja), metodologijo (oz. postopek preucevanja) in ideologijo (ali normativno držo). S tem pokaže na sorodnosti poimensko nezdružljivih naukov in razlike znotraj vsakega od njih. Na pasti in tveganja posamicnih pogledov na odnose med pravom in moralo pa ob tem opozori se s koncno razclenitvijo stalisc, znacilnih za odprti, zaprti in normativni pravni pozitivizem.
