Morala kot temelj in kriterij (vladavine) prava

Abstract

Problema razmerja med pravom in moralo je trajno prisoten v pravni znanosti. O njem je bilo spisanih vec teorij. Med nekaterimi obstajajo vecje razlike, druge pa se razlikujejo predvsem po odtenkih. Avtor clanka vztraja pri taksnem razumevanja in preucevanju prava, ki ohranja utemeljenost prava z moralo in njuno trajno povezanost. Pri tem se opira predvsem na razpravno teorijo prava in demokracije ter na proceduralno teorijo legitimnosti, kot ju je razvil Jurgen Habermas. Poseben pomen pri evropskem razumevanju razmerja med pravom in moralo pripise pravni filozofiji Gustava Radbrucha. Tudi on je vztrajal na trajni povezanosti prava in morale. Utemeljil je razliko med zakonskim nepravom in nadzakonskim pravom. Iz tega je izsla t.im. Radbruchova formula, ki ima dva vidika. Formula nevzdržnosti ugotavlja, ali je zakon vsebinsko nepravicen do nevzdržne mere. Formula zanikanja pa ugotavlja, ali zakon ne pomeni vec »prava« zaradi zavestnega zanikanja pravicnosti.
