Abstract

Dans l’Angleterre du xviiie siècle, une fraction infime des accusations d’agressions sexuelles amenait à des poursuites judiciaires. Bien que des affaires impliquant des hommes argentés soient extrêmement rares, il en existe quelques-unes, au cours desquelles des femmes de rangs sociaux inférieurs ont pu témoigner publiquement. Cet écart social était fréquemment utilisé contre les plaignantes, présentées comme des extorqueuses. Un argument apparaissant à plusieurs reprises dans la rhétorique de la défense comme dans celle de l’accusation est l’utilisation double de la francophilie et de la francophobie. Les hommes anglais bien nés étaient perçus comme francophiles, ce penchant directement lié par l’accusation à une inclination pour la violence sexuelle. A l’inverse, les avocats de la défense s’appropriaient ce qui semble avoir été un préjugé francophobe important, en présentant la plaignante et non pas l’accusé comme contaminée par la culture gallique. Le présent article propose une étude des minutes de deux procès pour viol à la mi-xviiie siècle, où l’écart de rang entre accusatrice et accusé a favorisé le déploiement de cette rhétorique. Dans un contexte juridique, la recherche d’une influence française sur les pratiques et identités sociales, genrées et sexuelles devient une question de vie ou de mort.
