L’article propose une révision historique et logique de la relation entre le droit privé moderne et le « commun ». À travers une archéologie du droit privé moderne, il explore les moments cruciaux qui ont déterminé l’effet d’antinomie apparente entre droit privé et multiplicité. La construction dogmatique du droit subjectif est le laboratoire permettant de vérifier la mise au point de cette opération sophistiquée, menée notamment par les juristes de l’École historique allemande. À cette histoire s’oppose la possibilité de concevoir une relation différente entre droit privé et multiplicité, à partir de la notion de droits trans-subjectifs.
