Les nouveaux fondements de la régulation transnationale privée

Abstract

Après une première section introductive, nous identifierons, dans la section 2 de cet article, les facteurs conduisant à l’émergence d’une nouvelle régulation transnationale privée (RTP) en la comparant d’une part avec la lex mercatoria , d’autre part avec les régimes de droit international public. La section 3 s’intéressera au secteur privé, plus particulièrement sur les différents conflits d’intérêts susceptibles de naître dans le cadre de la relation de régulation et sur la nécessité de développer des réponses de gouvernance appropriées. Dans la section 4, nous examinerons la complémentarité institutionnelle entre les régimes de droit public et de droit privé. Au vu de ces développements, on constatera l’existence de différences entre le public et le privé au niveau global. La division public/privé est analysée en comparant les niveaux national et transnational. Quatre modèles différents d’interactions sont alors identifiés : hybridation, collaboration législative, coordination et compétition. La section 5 offrira un résumé des résultats de l’analyse, et reconsidérera les confins du public et du privé au niveau transnational.
