Abstract

La fraude fiscale n'a sans doute jamais ete aussi vivement et officiellement decriee que depuis le G20 d'avril 2009. Avec la stigmatisation renouvelee des paradis fiscaux et les actions politiques prises a leur encontre au plus haut niveau des instances internationales, un espoir renait: celui d'un monde ou finance ne rimerait pas avec impuissance mais avec transparence. Nul n'imaginait, il y a moins d'une decennie, que le secret bancaire suisse serait mis en danger a breve echeance. Nul ne pensait que les paradis fiscaux disperses sur la face de la terre prendraient l'engagement d'echanger avec les administrations etrangeres des informations necessaires au controle du respect des obligations fiscales. Aujourd'hui pourtant, sous la pression conjuguee de nombreux Etats et grâce aux efforts continus deployes dans le cadre de l'OCDE depuis 1998, ces evenements impensables se produisent. L'experience enseigne certes que les paroles, meme formulees comme des promesses, ne sont pas toujours suivies des effets esperes. Il suffit pourtant de voir certains Etats sortir de leur mutisme ou de leur isolement pour se convaincre qu'un changement bien reel se dessine. Bien que le monde ideal ne soit pas pour demain, il n'en avance pas moins dans la bonne direction. Mais desormais se posent les questions suivantes: disposera-t-on de moyens efficaces pour realiser ces progres ? La regle juridique en matiere de lutte contre la fraude et l'evasion fiscales sera-t-elle marginalisee ou confortee ?
