Abstract

Dès la seconde moitié du xviii e siècle, la répression du vol est exponentielle en Europe. La poursuite pénale du vol intra-familial (larcins, détournements successoraux) est pourtant rarissime, alors même que les vols dans la parenté apparaissent en filigrane de maints procès instruits dans le vaste ressort du parlement de Paris, entre 1694 et 1775. Cet article explore les fondements juridiques de cette présence en demi-teinte. Jamais poursuivis à titre principal, les larcins conjugaux ou parentaux constituent une circonstance aggravante des violences (adultère, voies de faits, homicides) judiciarisées dans la plus haute cour d’appel du royaume. Bien avant sa reconnaissance légale dans le Code pénal de 1810, la règle de l’immunité familiale en matière de vol est empiriquement élaborée dans l’ancien droit pénal qu’appliquent les tribunaux de la juridiction parisienne.
