Responsabilidad legal y procedimental en daños ambientales

Abstract

La Constitución ecuatoriana reconoce la vulnerabilidad del medio ambiente y, por esta razón, otorga a la naturaleza el estatus de sujeto de derecho. Este estudio se planteó como objetivo analizar el procedimiento administrativo relacionado a la responsabilidad objetiva por daños ambientales. La metodología fue de enfoque mixto y alcance descriptivo. La muestra estuvo conformada por 3 abogados especialistas en materia ambiental y 40 abogados. Se emplearon como técnicas la encuesta y la entrevista. Los resultados arrojaron que se destaca la evolución de los fundamentos jurídicos desde 2008, reconociendo la protección de la naturaleza como sujeto de derecho. El procedimiento administrativo para prevenir daños ambientales se considera eficaz, aunque se señala la necesidad de mejorar la agilidad y eficiencia de los trámites. La inversión de la carga probatoria es respaldada para permitir a las empresas demostrar su inocencia. Aunque se aprecian avances en el derecho ambiental, se subraya la complejidad de determinar la responsabilidad objetiva. Se concluye que hay diversidad de opiniones en Guayaquil sobre este tema, resaltando la importancia de preservar el derecho a la defensa y mejorar la agilidad de los procedimientos.
