Abstract

Bu çalışma, İslam hukuku ve mer'i hukuk arasında nafaka konusunu karşılaştırmalı olarak ele almaktadır. Nafaka, bireylerin yaşamlarını düzenleyen hukuk sistemlerinde önemli bir yer tutmaktadır. İslam hukuku, Kur'an ve sünnete dayanarak insanların temel ihtiyaçlarını karşılamak için düzenlemeler yapmıştır. Nafaka, fertlerin hayatlarının devamı, ihtiyaçlarının karşılanması ve ailelerinin geçimini sağlaması açısından önemlidir. Bu çalışma, nafakanın İslam hukukundaki önemini ve düzenlemelerini mer'i hukukla karşılaştırmalı olarak inceler. Nafakanın İslam hukukundaki yerini ve uygulamasını anlamak için bu çalışma önemli bir kaynak olacaktır. This study compares the topic of alimony in Islamic law and civil law. Alimony holds a significant place in legal systems that regulate individuals' lives. Islamic law has made provisions based on the Quran and Sunnah to meet individuals' basic needs. Alimony is important for the continuation of individuals' lives, meeting their needs, and providing for their families. This study examines the importance and regulations of alimony in Islamic law in comparison to civil law. It will serve as an important source to understand the place and implementation of alimony in Islamic law.
