Der Acte Clair in der deutschen Rechtsprechung zum Europäischen Zivilprozessrecht

Abstract

Knapp 40 Jahre nachdem der EuGH mit der Rechtssache CILFIT die Acte Clair-Doktrin in das Europarecht eingeführt hat, untersucht die Arbeit zum Europäischen Zivilprozessrecht die Vorlagepraxis und -bereitschaft der deutschen Gerichte. 50 Entscheidungen wurden im Kontext der bestehenden EuGH Rechtsprechung analysiert. Festgestellt wurde dabei, dass die nach CILFIT vorzunehmende Prüfung rein formeller Art ist und diese durch ein materielles Verständnis des Acte Clair ersetzt werden sollte und damit handhabbarer gemacht werden kann. Danach sollen die Gerichte, um eine erforderliche einheitliche Rechtsprechungspraxis der Mitgliedstaaten zu gewährleisten, insbesondere das Telos der anzuwendenden Normen ermitteln und als Korrektiv den Individualrechtsschutz berücksichtigen.
