Abstract

Der Artikel präsentiert eine Analyse der Ursprünge der Kunst. 7 der Rom-II-Verordnung als spezifische Kollisionsnorm, die das auf Umweltschäden anzuwendende Recht angibt. Es wurde darauf hingewiesen, dass es viele Gründe dafür gebe, eine Bestimmung zu Umweltschäden in die EU-Verordnung zur Vereinheitlichung des Kollisionsrechts im Deliktsrecht aufzunehmen. Die Einleitung und ihr Inhalt wurden durch die Umweltpolitik der Europäischen Union, die Anforderungen der Doktrin und die Rechtsprechung des Gerichtshofs der Europäischen Union bestimmt. Darüber hinaus bewertet der Artikel die Bedeutung von Art. 7 Rom II für den Rechtsverkehr und den Schutz der natürlichen Umwelt. Darüber hinaus ist das Beispiel von Art. 7 Rom II veranschaulicht perfekt den Einfluss des EU-Rechts auf das polnische (internationale) Recht.
