Abstract

Visa, o presente artigo, analisar a viabilidade da caracterização da ocorrência de dano moral coletivo com base no desrespeito das normas de distanciamento social impostas em razão da pandemia do novo coronavírus. Tomou-se como premissa para tanto o Sistema de Distanciamento Controlado instituído no Estado do Rio Grande do Sul. Com a verificação do conceito de aglomeração e a justificativa da sua proibição, intentou-se aferir a viabilidade de, à vista da realização de festas clandestinas, configurar-se o respectivo dever de indenizar. Para tanto, partiu-se dos conceitos doutrinário e jurisprudencial do dano moral coletivo, analisando a ocorrência dos seus pressupostos na hipótese apresentada.
