El pin parental y su contradicción con el derecho a la educación sexual integral. España y el Tribunal Europeo de Derechos Humanos

Abstract

Mediante el pin parental, los padres pueden objetar o vetar determinados contenidos de los programas educativos, por considerar que los mismos son contrarios a sus convicciones morales, religiosas y hasta filosóficas. Este veto parental tiene como fundamento el derecho preferente de los padres en la educación moral y religiosa de sus hijos. No obstante, tiene como límites los propios derechos y libertades fundamentales de niños y adolescentes. La educación sexual integral tiene por objetivo la adquisición de información precisa, neutral, plural y objetiva, basada en evidencia científica, apropiada para la edad y madurez sobre la sexualidad. El contenido de la educación sexual también comprende aspectos directamente relacionados con principios, valores democráticos y derechos fundamentales consagrados en la Constitución, esenciales para la convivencia pacífica y responsable en sociedad. El Estado en cumplimiento de su deber de neutralidad en la educación debe garantizar que los contenidos y la forma en que se imparta la educación sexual integral cumpla con las características de neutralidad, objetividad, pluralidad y no adoctrinamiento.
