El privilegio del agricultor en Colombia y la Comunidad Andina. Un análisis de la interpretación prejudicial 384-IP-2019 del Tribunal de Justicia de la Comunidad Andina

Abstract

El artículo analiza el privilegio del agricultor en el contexto colombiano y de la Decisión Andina 345 de 1993, contrastándolo con el Convenio de la UPOV en sus actas de 1978 y 1991. Se argumenta que el privilegio del agricultor, entendido como una excepción al derecho del obtentor, no se encuentra reconocido en el Acta de 1978. No obstante, algunos autores consideran que se encuentra implícito. Dicho privilegio concede a los agricultores la facultad de ejercer un uso propio de una variedad protegida cuando cumpla con determinados requisitos. El escrito profundiza en los desafíos conceptuales y normativos de esta excepción, abordando su impacto en la garantía y alcance del derecho de obtentor, para finalizar con un análisis de la interpretación prejudicial 384-IP-2019, del Tribunal de Justicia de la Comunidad Andina. Por último, se propone fomentar el diálogo entre actores clave para lograr un equilibrio entre los intereses de agricultores y obtentores, especialmente de cara a una posible adhesión al Acta de 1991.
