Maltrato animal como violencia vicaria: comentario a la sentencia 260/2025 del Juzgado de Violencia sobre la Mujer nº 2 de Las Palmas de Gran Canaria

Abstract

La creciente visibilización del vínculo afectivo entre personas y animales, así como el reconocimiento de las familias multiespecie, ha permitido identificar nuevas formas de violencia en el ámbito de las relaciones de género, en las que el daño a los animales de compañía se utiliza como instrumento de control y de sufrimiento psicológico. En este contexto, el presente trabajo analiza la sentencia 260/2025 dictada por el Juzgado de Violencia sobre la Mujer nº 2 de Las Palmas de Gran Canaria, de 22 de septiembre de 2025, que constituye un primer pronunciamiento judicial conocido en España en el que se califica el maltrato mortal a un animal de compañía como una forma de violencia vicaria. A partir de esta resolución, se examina la convergencia entre el Derecho penal de protección animal y el Derecho penal con perspectiva de género, atendiendo al marco normativo, doctrinal, empírico y comparado. El estudio sostiene que el maltrato animal puede operar, en determinados supuestos, como medio comisivo de violencia psicológica contra la mujer, integrándose conceptualmente en la violencia vicaria y abriendo nuevas líneas de desarrollo normativo, judicial e institucional.
