Abstract

Las abejas ocupan un lugar singular en la historia del Derecho: presentes desde el Digesto justinianeo hasta los grandes Códigos civiles del siglo XIX, han recibido siempre un tratamiento jurídico propio que reconoce su importancia biojurídica y su naturaleza escasamente domesticable. Hoy, ese tratamiento adquiere una nueva dimensión: en 2025, la Municipalidad Provincial de Satipo (Perú) declaró a las abejas sin aguijón (meliponinos) sujetos de derecho, inaugurando una vía normativa que se suma a los procesos constitucionales y legislativos en curso en América Latina. Esta contribución analiza las abejas, como caso de estudio privilegiado, para examinar las dos grandes vías a través de las cuales el Derecho Animal está transformando el estatuto jurídico de los animales: la reforma de los Códigos civiles mediante el reconocimiento de la sintiencia, y el reconocimiento judicial o constitucional de determinadas especies como sujetos jurídicos. ¿Cuál de estas estrategias ofrece mayor solidez, coherencia sistemática y garantías de protección efectiva para el futuro del Derecho Animal?
