Abstract

La cour d’appel se prononce sur le domaine de la notion d’« erreur sur l’ordre des privilèges » permettant au mandataire d’obtenir, en vertu de l’article L. 643-7-1 du Code de commerce, le remboursement de fonds versés par erreur lors des opérations de répartition. La Cour précise que le défaut de collocation par le liquidateur judiciaire d’un créancier privilégié ne procède pas d’une telle erreur car il ne « trouve son origine dans une erreur commise dans l’acte de collocation sur le classement légal des droits de préférence » mais dans le défaut de collocation d’un créancier qui disposait du droit d’y participer.
