Responsabilidad penal de los profesionales de salud, individual o compartida, en lesiones causadas por oblitos

Abstract

El objetivo de la presente investigación fue analizar la responsabilidad penal de los profesionales de salud, individual o compartida, en lesiones causadas por oblitos. Metodológicamente la investigación fue de tipo documental, que consistió en la revisión documental la cual incluyó investigaciones publicadas entre 2015 y 2025, evaluadas con herramientas JBI y criterios narrativos. Los resultados muestran que en algunos contextos se considera una responsabilidad compartida del equipo quirúrgico por fallas colectivas, mientras que en otros se atribuye de forma individual al cirujano principal. Factores como cirugías de urgencia y modificaciones del personal influyen en la valoración jurídica. En conclusión, protocolos claros y cultura de seguridad son esenciales para disminuir riesgos clínicos y legales. También se observa que condiciones clínicas como las cirugías de urgencia o la presencia de pacientes con alto riesgo influyen en la valoración jurídica de cada caso.
