Abstract

O Direito de Autor está na ordem do dia. A polarização da opinião pública e a imprevisibilidade do progresso tecnológico explicam, em larga medida, a crescente dificuldade em dar resposta legislativa aos desafios emergentes. Neste contexto, o desenvolvimento do Direito de Autor tem ficado sobretudo a cargo dos tribunais. Reúnem-se nesta obra os excertos mais relevantes de decisões jurisprudenciais e, aqui e ali, de outras fontes ilustrativas dos problemas fundamentais do Direito de Autor. A seleção inclui jurisprudência nacional, estrangeira (Alemanha, Brasil, Estados Unidos, França e Reino Unido), internacional (OMC) e da UE. Os excertos são antecedidos de breves textos introdutórios e sucedidos de questões que estimulam a reflexão crítica. A obra destina-se aos estudantes da disciplina de Direito de Autor e aos juristas que lidam profissionalmente com este ramo, que exige um constante esforço de atualização. Esta segunda edição apresenta-se, por isso, substancialmente revista, contando com 26 novas entradas.
