Abstract

The main purpose of this book is a legal analysis of a legal position of the units, with a reference to the privatization of the medical entities. The Constitution of the Republic of Poland in article 68 paragraph 1, provides that every unit has a right to healthcare. In the Polish jurisprudence there is no absolute consent, that the right to healthcare should be qualified as a public subjective right. After the verification, if the right to healthcare is a public subjective right, the second – and the main – purpose was the answer about the change of the legal position of the units, with a reference to the privatization of the medical entities. The Author was focused especially on the privatization of the Independent Public Healthcare Center (SPZOZ – operating under the Healthcare Institutions Law), because this entities are primary in the Polish public healthcare system.

Publikacja zawiera analizę sytuacji prawnej jednostki (pacjenta) i jej modyfikacji na skutek procesów prywatyzacyjnych w ochronie zdrowia. Przedmiotem badań ujętych w publikacji były w szczególności przekształcenia organizacyjne i własnościowe Samodzielnych Publicznych Zakładów Opieki Zdrowotnej, albowiem te podmioty lecznicze należy uznać za filary krajowego systemu opieki zdrowotnej. Autor dokonuje także weryfikacji natury prawa do ochrony zdrowia. Konstytucja Rzeczypospolitej Polskiej w art. 68 ust. 1 stanowi, że każdy ma prawo do ochrony zdrowia. W literaturze prawniczej występują różne poglądy na temat natury normatywnej powyższej regulacji. Pojawiają się rozbieżności w zakresie kwalifikacji prawa do ochrony zdrowia do katalogu publicznych praw podmiotowych.
