Abstract

Suite à l’accord institutionnel sur la 6ème réforme de l’État belge (2011), la juridiction du Conseil d’État et des autres juridictions administratives sera élargie aux conséquences de droit privé des recours en annulation. Conformément aux intentions prévues de l’accord, la réforme sera matérialisée par le biais d’une modification de l’article 144 de la Constitution. La réforme annoncée contraint la prise en compte de nombreuses implications qui seront analysées dans cette contribution. Il est en outre recommandé de réfléchir quant à un élargissement continu et à une diversification des compétences en matière de jugement du juge administratif. Pour finir, les décideurs doivent développer une vision claire concernant le renouvellement du pluralisme juridictionnel actuel ou l’évolution vers le monisme. Le droit comparé fonctionnel offre des perspectives intéressantes afin de répondre à des questions relatives à la mise en application des réformes.
