Prejudicialidad en la justiciabilidad constitucional de derechos sociales: análisis del caso Nº 1773-11-EP

Abstract

En el análisis del caso Nº 1773-11-EP se evidencia que, en la práctica, se limita el ejercicio de la justicia constitucional respecto a categorías jurídicas como la propiedad, tratándose de un derecho social que, según los jueces de instancia, debía resolverse en el ámbito civil. Por ello, el objetivo de esta investigación fue analizar la prejudicialidad en la justiciabilidad constitucional de los derechos sociales, revisando la sentencia 146-14-SEP-CC dictada en el caso Nº 1773-11-EP, mediante un estudio de caso cualitativo. Los resultados demuestran que el desarrollo de criterios de prejudicialidad para tratar los derechos sociales representa una vulneración indirecta de los derechos involucrados cuando, por la gravedad de la situación, se afecta a bienes jurídicos superiores. Por tanto, más allá de las alternativas de solución judicial, esta investigación promueve la inclusión de metas solidarias que atiendan la raíz de la violación de derechos sociales. Las conclusiones evidencian que, al ser elevados a derechos fundamentales, los derechos sociales son plenamente justiciables en vía constitucional.
