Abstract

O objetivo deste artigo é investigar a origem de uma controvérsia sobre as águas minerais: elas serão um recurso hídrico ou um recurso mineral que deve permanecer submetido ao Código de Mineração brasileiro? Para que seja possível transitar pelos subterrâneos dessa querela, foi preciso realizar uma prospecção. Trata-se de uma investigação que mistura água, ciência e política. No artigo está descrito o modo pelo qual a legislação que trata das águas minerais foi alterada conforme os diferentes momentos políticos. Assim, foi possível inferir que, atualmente, o Código de Mineração parece insuficiente para lidar com as demandas daqueles que falam de onde brotam as águas minerais. A região sul de Minas Gerais é o caso emblemático, aqui apresentado, da ocorrência de conflitos gerados por essa instabilidade institucional. É aí que a Política Nacional de Recursos Hídricos pode oferecer a sua contribuição, já que é mais territorializada e participativa se comparada com a legislação mineral. Agenciar as águas minerais à Lei das Águas é o desafio que se anuncia, ao que chamamos de "outra desmineralização".
