Novel foods - challenges for food law

Abstract

L’articolo analizza alcuni aspetti della vasta problematica dei novel foods. In particolare focalizza l’attenzione sulla definizione giuridica di novel foods, sulla sicurezza degli alimenti realizzati con metodi di produzione innovativi e sugli strumenti per garantire la tutela del consumatore. Lo scopo dell’analisi e tentare di risolvere i dubbi che circondano il campo di applicazione e l’uso dei novel foods. La disciplina dovrebbe essere aperta a recepire ulteriori sviluppi tecnologici e l’uso di nuovi metodi di produzione, tanto che in dottrina si evidenzia la necessita di una modifica dell’attuale regolamento (CE) n. 258/97. Eventuali divaricazioni tra il diritto e lo sviluppo tecnologico non sono, infatti, auspicabili per molte ragioni, anche di natura socio-economica. Cio che piu conta e che gli strumenti giuridici che garantiscono la sicurezza dei novel foods siano in grado di proteggere efficacemente il consumatore, l’ambiente e la biodiversita.
