Abstract

Jednym z podstawowych uprawnień wiernych w Kościele jest prawo do obrony. Zostało ono zagwarantowane w Kodeksie Prawa kanonicznego z 1983 r., zarówno w przepisach dotyczących podstawowych uprawnień i obowiązków wszystkich wiernych chrześcijan, jak i w przepisach proceduralnych procesu kanonicznego. Prawo do obrony dla pełnego zabezpieczenia, jak i możliwości praktycznego korzystania z niego, domaga się wierności w przestrzeganiu przepisów procesowych. Niewłaściwe stosowanie prawa prowadzi do nadużyć, hamuje, utrudnia, bądź czyni niemożliwym korzystanie z tego uprawnienia.
