Chrzest dziecka przy zgodzie tylko jednego rodzica

Abstract

Artykuł jest analizą prawną problemu chrztu św. dziecka w przypadku, kiedy wyraża zgodę tylko jeden rodzic, a drugi wyraźnie się temu sprzeciwia. Ze względu na specyfikę problemu przeanalizowano przepisy prawa dwóch porządków prawnych: prawa kanonicznego oraz polskiego prawa państwowego. W ten sposób można było wykazać autonomię Kościoła katolickiego w sprawach duchowych, a w konsekwencji autonomię prawa kanonicznego w stanowieniu prawa co do sakramentów. Taką autonomię potwierdzają źródła prawa państwowego: Konkordat między Rzecząpospolitą Polską a Stolicą Apostolską oraz ustawa o stosunku Państwa do Kościoła Katolickiego. W praktyce autonomia ta jest szanowana, co można określić na podstawie orzecznictwa polskich sądów.
