Abstract

Penelitian ini membahas peran Badan Pengawas Obat dan Makanan (BPOM) dalam pengawasan produk obat sirup yang dapat menyebabkan gagal ginjal akut pada anak-anak di Indonesia. Kasus ini terjadi akibat adanya cemaran zat berbahaya seperti Ethylene Glycol (EG), Diethylene glycol (DEG), dan Ethylene Glycol Butyl Ether (EGBE) dalam obat sirup, termasuk produk dari PT Afirma. Meskipun produk obat harus terdaftar dan mendapatkan izin edar dari BPOM, kasus gagal ginjal akut pada anak-anak tetap terjadi karena beberapa produk obat ditemukan mengandung cemaran di atas ambang batas. Penelitian ini menggunakan pendekatan hukum normatif dengan analisis kualitatif, dengan sumber data primer dari wawancara dengan staff BPOM dan data sekunder berupa undang-undang, buku hukum, dan jurnal hukum. Hasil penelitian menunjukkan bahwa BPOM, didukung oleh Unit Pelaksana Teknis di daerah, bertanggung jawab atas pengawasan obat pre-market dan post-market. Namun, pelaksanaannya di lapangan masih belum maksimal karena uji sampel obat post-market tidak dilakukan secara menyeluruh, memungkinkan pemasok tidak bertanggung jawab memanfaatkan celah untuk memasarkan produk dengan cemaran di atas ambang batas. Untuk mengatasi kendala ini, BPOM perlu meningkatkan pengawasan post-market dan menemukan solusi yang relevan agar tidak terulangnya kejadian yang merugikan.
