Abstract

Entrando al tema central, “el positivismo surgió como lógica reacción contra las abstracciones y vaguedades del iusnaturalismo decadente” 163. Es una escuela filosófica que defiende al conocimiento científico como el conocimiento auténtico. El positivismo surge en Francia a inicios del Siglo XIX gracias a Augusto Comte y a Jhon Stuart Mill y es una tesis que defiende la exclusividad del Derecho Positivo, rechaza toda idea de un derecho natural, ya que sus principios del derecho no surgen de la naturaleza, sino que están implícitos en la ciencia
