O presente trabalho busca apresentar a teoria do direito do jurista, filósofo político e economista austríaco Friedrich August von Hayek como salvaguarda da liberdade individual contra o poder do Estado e, por conseguinte, como contraponto às doutrinas jurídicas dominantes defensoras da presença massiva do estado na esfera privada.
