A soberania e a responsabilidade estatal por danos ambientais transfronteiriços.

Abstract

A responsabilizacao de quem degrada o meio ambiente e um dos instrumentos mais notaveis utilizados pelo Direito. A finalidade da responsabilizacao civil e restituitoria. O dano ambiental transfronteirico e elemento nuclear para compor o sistema de responsabilidade civil ambiental. Estados, pelo conceito classico da soberania, nao admitem qualquer tipo de ingerencia em sua jurisdicao. A apuracao da culpa do Estado infrator e tarefa laboriosa quando nao inviavel devido ao primado da soberania. O objetivo deste trabalho consiste em analisar como a soberania constitui-se em um entrave para responsabilizacao internacional de um Estado no dano ambiental transfronteirico. A abordagem cientifica adotada e qualitativa com metodo dialetico e comparativo. Assim constata-se que a possibilidade de flexibilizacao da soberania estatal e solucao para atender a novos interesses globais, como a protecao ambiental, viabilizando a responsabilizacao do Estado e a devida reparacao do dano.
