Abstract

A Teoria dos Jogos é um campo de estudo que busca entender o comportamento estratégico dos indivíduos em situações de interação. Inicialmente desenvolvida no campo da economia, a Teoria dos Jogos tem se expandido para diversas áreas, incluindo o Direito. Neste contexto, uma das mudanças paradigmáticas mais significativas é a transição da justiça conflitiva para a justiça consensuada. Nesta discussão, exploraremos como a Teoria dos Jogos pode contribuir para essa mudança de paradigma, analisando suas aplicações no contexto jurídico e as vantagens da busca por soluções consensuais. A Teoria dos Jogos no Direito Penal é uma abordagem que utiliza os conceitos e métodos da Teoria dos Jogos, uma disciplina da matemática aplicada, para analisar as interações estratégicas entre os participantes do sistema penal. Essa abordagem busca compreender as escolhas, as estratégias e as consequências dessas interações, considerando os incentivos e os interesses dos diferentes atores envolvidos no âmbito jurídico-penal.
