OFFENSES IN IRAQI CRIMINAL LAW

Abstract

Irak Ceza Hukuku'nun temeli, 1918'de çıkarılan Bağdadi Ceza Kanunu ile atıldı. Ancak, bu kanunun eksiklikleri ve uygulanma zorlukları nedeniyle, 1969'da Ceza Kanunu'nu geliştirmek amacıyla yeni bir yasa çıkarıldı. 1969 Ceza Kanunu, Bağdadi'nin hatalarını düzeltmeye yönelik çabaların bir ürünü olarak ortaya çıktı ve hukuki süreçlerin anlaşılabilirliğini artırdı. Ancak, hala hatalar, belirsizlikler ve eksiklikler gibi kabahatlerle karşılaşılmaktadır. Hukuki tasarımlarda daha dikkatli bir yaklaşım benimsemek ve mevcut yasal çerçeveyi iyileştirmek, Irak ceza hukukunun daha etkili ve adil bir şekilde işlemesini sağlamak için önemlidir.
