Abstract

La categoría identitaria de «mujer» ha experimentado grandes cambios, uno fundamental está relacionado con la posibilidad de transigir el género. Es así como la visión biológica, que alguna vez fue la única que se consideró, ha perdido fuerza. El reconocimiento de las mujeres transgénero y transexuales es prueba de ello. Estas mujeres, como muchas otras, a menudo, experimentan violencia de género por contradecir las expectativas sociales de uniformidad identitaria, por lo que el tipo penal de feminicidio representa una forma punitiva de combatir dicho flagelo en el corto plazo. Sin embargo, persiste la duda en la doctrina penal y el mundo del derecho sobre si estas mujeres pueden o no ser sujetos pasivos de dicho delito. En este artículo, pretendemos hacer un análisis comparado teórico-jurisprudencial de la figura del feminicidio, para observar cómo se resuelve el problema relacionado con la inclusión o exclusión de mujeres trans como sujetos pasivos de este tipo penal en países como Argentina, Brasil y Colombia.
