HOBBES: ENTRE EL IUSNATURALISMO Y EL IUSPOSITIVISMO

Abstract

En este trabajo revisaremos el pensamiento de Hobbes a luz de las dos grandes tradiciones jurídico-filosóficas de la Modernidad (el iusnaturalismo y el iuspositivismo) para mostrar que este autor no puede inscribirse estrictamente en ninguna de estas corrientes, pues si bien algunos elementos pueden llevarnos a considerarle un filósofo iusnaturalista, lo cierto es que otros aspectos nos orillan a reconocerlo precursor del iuspositivismo. Pero esta dualidad, en lugar de constituir un dilema para los intérpretes que se empeñan en ubicar a este autor en uno u otro punto cardinal de la filosofía del derecho, debería considerarse una virtud del pensamiento hobbesiano, pues veremos que gracias a ella Hobbes desarrolla una concepción plural del orden social.
