Polityka kryminalna a model kurateli sądowej

Abstract

Autor poddaje analizie związki między polityką kryminalną a modelem kurateli w perspektywie historycznej. Podstawową tezą pracy jest rozejście się założeń leżących u fundamentu modelu kurateli probacyjnej z represyjną polityką kryminalną prowadzoną współcześnie. Brak spójności prowadzi do zagrożeń funkcjonalnych i aksjologicznych. Nadziei na zmianę sytuacji upatrywać należy w kryzysie populizmu penalnego i zmianach prawnych z tym związanych, dokonywa- nych zwłaszcza w USA.
