Abstract

El dolo, desde la perspectiva de la doctrina mayoritaria, se compone de dos elementos: uno cognitivo y uno volitivo. Si bien la doctrina afianzada ha desarrollado estos elementos de manera prolija y convincente, los problemas se reflejan en su aplicación en la realidad jurídico-procesal, en donde el elemento subjetivo de la voluntad (el más problemático), parece imposible de probar y, en este contexto, se recurre a soluciones que podrían interpretarse como contradictorias respecto de dicha conceptualización. Así, observamos la utilización de la teoría de la probabilidad, la deducción del elemento volitivo en base al conocimiento de los elementos que hacen típica una conducta o, incluso, la falta de valoración del elemento volitivo en el caso concreto. Ello nos lleva a preguntarnos si es necesaria la voluntad para la fundamentación del dolo o si por el contrario es un criterio doctrinal de imposible aplicación práctica. La respuesta, desde la perspectiva de este artículo, la encontraremos en el desarrollo jurisprudencial y, en cierta medida, en aquella doctrina minoritaria que considera que el elemento volitivo es irrelevante para la configuración del dolo.
