Abstract

Monografia (graduação)—Universidade de Brasília, Faculdade de Direito, 2011. ; O controle da atividade policial é instrumento essencial ao Estado de Direito, sob o paradigma do constitucionalismo democrático. Configura direito fundamental dos cidadãos contra o uso arbitrário da força pelo Estado. A Constituição de 1988 previu um modelo dúplice de controle da polícia: interno e externo, sem prejuízo do exercido por órgãos não estatais. O controle externo da atividade policial foi atribuído ao Ministério Público, como função institucional. A realidade da ineficiência do controle demanda a reformulação do modelo atualmente adotado. Nesse sentido, é fundamental prezar pela cooperação interinstitucional entre polícia e Ministério Público, com vistas a assegurar a efetividade do controle da atividade policial e evitar a continuidade de situações violadoras de direitos na prática policial. ; It is essential for the rule of law and for the democracy to effectively control the police. It is also a fundamental right that protects citizens against the arbitrary use of force by the State. The Brazilian Constitution of 1988 established a model of dual control of the police: internal and external, not excluding the control made by civil organizations. The external control of police activity was attributed to the Public Prosecutor’s Office as its institutional mission. The actual failure of police control in Brazil requires the reformulation of the model currently adopted. In this sense, it is crucial to prioritize the cooperation between police and Public Prosecutor’s Office, in order to ensure the effectiveness of the control over police activity and to avoid irregularities and human rights violations by police officers.
