El reto del sistema de reestructuración patrimonial : ser una herramienta que contribuya a reducir los costos de coordinación y de transacción entre el deudor y sus acreedores
Analiza la posibilidad del sistema de reestructuración patrimonial en la que participe el Estado y que concentre sus esfuerzos hacia tres objetivos: (a) maximizar el valor del negocio del deudor una vez producida una crisis; (b) generar un ambiente idóneo para la negociación entre acreedores y el deudor; y, (c) reducir los costos de acceso al capital.
