Abstract

Der andauernde Krieg in der Ukraine hat die Entwicklung und den Einsatz unbemannter Luftfahrzeuge (UAVs) erheblich beschleunigt und zeigt eindrucksvoll, wie dringende militärische Erfordernisse technologische Innovationen vorantreiben können. Dieser Krieg hat eine technische Revolution ausgelöst, angetrieben durch das Bestreben, menschliche Verluste zu minimieren, indem Soldaten bei gefährlichen Aufgaben durch robotische Systeme ersetzt werden. Gleichzeitig reichen die Auswirkungen dieser Entwicklungen weit über das Schlachtfeld hinaus. Mit dem Fortschritt der UAV-Technologie wird ihr Einsatz im zivilen Sektor zunehmend vorangetrieben – mit Fragen danach, wann drohnenbasierte Liefersysteme menschliche Kuriere ersetzen könnten oder wann persönliche Fluggeräte Realität werden könnten. Weltweit erkennen Staaten die strategischen Vorteile von UAVs und reagieren mit verstärkten Investitionen und Innovationsanstrengungen, was zu einem rasanten Wachstum sowohl im militärischen als auch im zivilen Drohnensektor führt. Diese schnelle Ausbreitung stellt jedoch erhebliche regulatorische Herausforderungen dar. Die bestehenden luftrechtlichen Regelwerke sind unzureichend darauf vorbereitet, die steigende Anzahl und Komplexität von UAV-Einsätzen zu bewältigen. Diese Masterarbeit untersucht die aktuellen rechtlichen Rahmenbedingungen und regulatorischen Praktiken im Umgang mit UAVs in der Europäischen Union und der Ukraine. Sie vertritt die These, dass Regierungen dringend die gesellschaftlichen und sicherheitspolitischen Auswirkungen der UAV-Integration berücksichtigen und durch flexible, vorausschauende Regelungen begleiten müssen. Solche Maßnahmen sind entscheidend, um Innovation mit öffentlicher Sicherheit in Einklang zu bringen und sicherzustellen, dass technologischer Fortschritt dem Gemeinwohl dient.

The ongoing war in Ukraine has significantly accelerated the development and deployment of unmanned aerial vehicles (UAVs), illustrating how urgent military needs can drive rapid technological innovation. This war has sparked a technical revolution, driven by the imperative to reduce human casualties by replacing soldiers in high-risk tasks with robotic alternatives. At the same time, the implications of these advancements are extending far beyond the battlefield. As UAV technology evolves, it is increasingly adopted by the civil sector, raising questions about how soon drone-based delivery systems might replace human couriers or when personal aerial mobility devices. Globally, nations are observing the strategic advantages of UAVs and responding with increased investment and innovation, leading to rapid growth in both military and civilian drone markets. However, this swift expansion presents significant regulatory challenges. Existing airspace governance frameworks are ill-equipped to manage the rising volume and complexity of UAV operations. This thesis explores the current legal frameworks and regulatory practices governing UAVs in the European Union and Ukraine. It argues that governments must urgently address the societal and security implications of UAV integration by adopting flexible, forward-looking regulations. Such measures are essential to balance innovation with public safety, ensuring that technological progress serves the broader interests of society.
