Abstract

This thesis analyses the legal framework for renewable energy communities in Austria, with particular regard to the relevant European Union legislation, especially Directive (EU) 2018/2001 on the promotion of the use of energy from renewable sources (RED II), and its transposition into national law through instruments such as the Electricity Industry and Organisation Act 2010 (Elektrizitätswirtschafts- und -organisationsgesetz, ElWOG) and the Renewable Expansion Act (Erneuerbaren-Ausbau-Gesetz, EAG). It distinguishes between various legal models of energy cooperation, including joint generation facilities, citizen energy communities, and renewable energy communities. In addition, the study examines applicable support schemes, the legal delineation between trade law and electricity law, and the classification of energy communities under market participation rules. The objective is to identify key legal requirements and challenges related to the establishment and operation of energy communities and to support the broader implementation of the energy transition.

Diese Arbeit untersucht die rechtlichen Rahmenbedingungen für Erneuerbare-Energie-Gemeinschaften (EEG) in Österreich unter Berücksichtigung unionsrechtlicher Vorgaben, insbesondere der RED II, sowie deren innerstaatliche Umsetzung im ElWOG 2010 und EAG. Neben der Differenzierung der Modelle der Gemeinschaftlichen Erzeugungsanlagen, der Bürgerenergiegemeinschaften und der Erneuerbaren Energiegemeinschaften werden auch die bestehenden Fördermöglichkeiten dargestellt. Zusätzlich werden Fragen zur rechtlichen Einordnung zwischen Gewerbe- und Elektrizitätsrecht sowie zur Marktteilnehmereigenschaft von EEGs behandelt. Ziel ist es, die wesentlichen rechtlichen Voraussetzungen und Herausforderungen im Zusammenhang mit der Gründung und dem Betrieb von EEGs darzustellen und einen Beitrag zur Umsetzung der Energiewende zu leisten.
