Private enforcement of competition law through collective redress

Abstract

Die Masterarbeit befasst sich mit kleinen und weitverbreiteten überhöhten Preisen infolge wettbewerbswidrigen Verhaltens, das Verbraucher schädigt und zu geringen Schäden führt, die keine Individualklagen rechtfertigen. Ziel ist es, kollektive Rechtsschutzmechanismen zur privaten Durchsetzung des Wettbewerbsrechts im brasilianischen und portugiesischen Kontext mit Hilfe einer vergleichenden Forschungsmethodik zu untersuchen. Der europäische Rahmen, der den portugiesischen kollektiven Rechtsschutz im Wettbewerbsrecht ermöglicht, wurde untersucht. Die empirische Untersuchung umfasste die Analyse von Gerichtsverfahren, in denen das Forschungsthema behandelt wurde. Dabei zeigte sich, dass die brasilianischen Musterverfahren als verbindliche Präzedenzfälle dienen, um widersprüchliche Entscheidungen in bereits anhängigen Fällen zu vermeiden. Sie adressieren jedoch nicht das Problem der Trägheit der Verbraucher bei der Geltendmachung kartellrechtlicher Schadensersatzansprüche.

The master thesis focuses on small and widespread overcharges resulting from anticompetitive behavior that harm consumers, resulting in minor damages that do not justify individual lawsuits. The aim is to investigate collective redress mechanisms for private enforcement of Competition Law in both Brazilian and Portuguese contexts using comparative research methodology. The European framework enabling Portuguese collective redress for Competition Law was examined. Empirical research involved analyzing lawsuits discussing the research topic, revealing that Brazilian test cases serve as binding precedents to prevent conflicting rulings on already filed cases. However, they do not address the issue of consumer inertia in seeking antitrust damages.
