Rethinking international legal frameworks against child sexual abuse material online

Abstract

Angesichts des umfassenden Problems von Kindesmissbrauchsmaterial (Child Sexual Abuse Material, CSAM) im Netz untersucht diese Studie die Wirksamkeit der internationalen Rechtsrahmen der Convention on the Rights of the Child (CRC), des Optional Protocol on the Sale of Children, Child Prostitution and Child Pornography (OPSC) sowie der Budapest Convention on Cybercrime. Anhand einer Zwei-Länder-Analyse von Deutschland und Südkorea wird in dieser Studie untersucht, wie diese internationalen Regelwerke auf nationaler Ebene umgesetzt werden. Darüber hinaus hebt diese Studie den interdisziplinären Charakter des Problems hervor, indem sie die rechtliche Analyse mit einer psychologischen Perspektive verknüpft, um die Relevanz und gleichzeitige Vernachlässigung präventiver Strategien im Vergleich zu der Kriminalisierung von Straftätern aufzuzeigen. Die Ergebnisse weisen auf erhebliche rechtliche Lücken sowohl im internationalen- als auch im regionalen Rechtsrahmen hin, insbesondere im Hinblick auf die uneinheitliche Umsetzung in verschiedenen Rechtsordnungen und die unzureichende Betonung präventiver Maßnahmen für Personen, die ein Risiko darstellen. Diese Arbeit spricht sich deshalb für einen robusteren internationalen Rechtsrahmen aus, der dem Schutz der Kinderrechte Vorrang einräumt und umfassendere Präventionsstrategien vorsieht, um Straftaten zu verhindern, bevor sie passieren. Experteninterviews mit Fachleuten aus verschiedenen Bereichen des Kinderschutzes bieten praktische Einblicke in die Herausforderungen und Chancen der Bemühungen gegen CSAM.

Given the increasing prevalence of Child Sexual Abuse Material (CSAM) in the digital sphere, this study examines the effectiveness of the international legal frameworks of the Convention on the Rights of the Child, the Optional Protocol on the Sale of Children, Child Prostitution and Child Pornography and the Budapest Convention on Cybercrime. Through a two-country analysis of Germany and South Korea, this research explores how these international frameworks are implemented at the national level. Furthermore, this study highlights the interdisciplinary nature of the problem by integrating legal analysis with a more psychological perspective to discuss the relevance and neglect of preventive strategies compared to the criminalisation of offenders. Findings have revealed significant legal gaps in both international and regional frameworks, especially in terms of inconsistent implementation across jurisdictions and the insufficient emphasis on preventive measures for individuals at risk of offending. This thesis argues for a more holistic international legal framework that prioritises the protection of children's rights and looks at the issue from an interdisciplinary approach that incorporates prevention strategies to prevent crimes before they occur. Expert Interviews with professionals from different areas of child rights protection provide practical insights into the challenges and opportunities in the global efforts against CSAM.
