Abstract

Welche Rechte bestehen an Forschungsdaten (FD) und wer ist Rechtsinhaber? Diese Arbeit sucht Antworten auf diese Fragen zunächst im UrhG. Anschließend wird untersucht, ob Leitlinien der Deutschen Forschungsgemeinschaft zur guten wissenschaftlichen Praxis (GWP) Rechte an FD vermitteln können. Weitere Rechtspositionen ergeben sich i. d. R. nicht aus dem einfachen Recht. Deshalb nimmt die Arbeit einzelne deliktsrechtliche Ansprüche an solchen ungeschützten FD an, wenn sie in Ausübung der Forschungsfreiheit entstanden sind. Die Inhaberschaft richtet sich – gleich ob es sich um urheberrechtlich geschützte oder ungeschützte FD handelt – nach der hochschulrechtlichen Statusgruppe und dem Entstehungskontext der FD. Bedingt durch die GWP verbleiben zumindest einfache Nutzungsrechte bzw. -befugnisse bei den Forschenden.

What rights apply to research data (FD) and who is the rights holder? This dissertation first looks for answers to these questions in the German Copyright Act (UrhG). It then examines whether guidelines of the German Research Foundation on Good Scientific Practice (GWP) can provide rights to FD. Other legal positions generally do not arise from sub-constitutional law. Therefore, the thesis assumes individual tort law claims to such unprotected FD if they originated in the exercise of research freedom. The ownership of rights - regardless of whether the FD is protected by copyright or unprotected - depends on the academic status group and the context in which the FD originated. Due to the GWP, at least simple rights of use remain with the researchers.
